EarthMoving Finance, ABN 52 452 030 694 ("EarthMoving Finance", "we", "us", "our"). This policy explains how we collect, use, sell and disclose personal information in connection with our equipment and machinery finance comparison and lead-referral service, in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). By submitting an enquiry through our site, you consent to the collection, use and disclosure of your information as described in this policy.

1. Who we are and what we do

EarthMoving Finance operates a website that allows visitors to submit enquiries for equipment and machinery finance. We are a referral and lead-generation service: we do not provide credit ourselves. Instead, we pass ("sell") the details you submit to third-party lenders, finance brokers and other financial services providers on our panel, who may contact you directly to offer or arrange finance. We may be paid a fee or commission by these third parties for each lead or enquiry we provide, whether or not you proceed with finance.

2. Information we collect

We may collect:

  • Identity and contact details: full name, email address, phone number, mailing address.
  • Business details: ABN/ACN, business name, entity type, trading history.
  • Finance and equipment details: purchase price, make/model, new or used, deposit, employment or business income information, and other details relevant to a finance application.
  • Credit-related information, where you provide it or a lender obtains it as part of assessing your enquiry (via a credit reporting body).
  • Technical information: IP address, browser/device type, pages viewed, referring site and other analytics data collected automatically via cookies or similar technologies.

3. How we use your information

We use your information to operate and improve our comparison service, respond to your enquiry, match you to relevant lenders or brokers on our panel, and — as set out in Section 4 below — to sell or disclose your details to those third parties so they can contact you. We do not make credit decisions ourselves; any assessment, approval, rates, fees and conditions are entirely at the discretion of the lender you are referred to.

4. We sell and disclose your details to lenders and financial services providers

This is the most important part of this policy. When you submit a quote request or enquiry form on our site, you expressly acknowledge and agree that:

  • Your personal information (name, contact details, business details, equipment and finance requirements, and any other details you provide) will be shared with, sold to, and/or disclosed to one or more third-party lenders, finance brokers, aggregators and other financial services providers that form part of our lender panel or partner network.
  • We may receive a referral fee, commission or other payment from these third parties in exchange for providing your details as a lead, regardless of whether you ultimately take out finance with them.
  • These third parties may contact you directly — by phone, SMS, email or mail — to market or offer finance products, and their use of your information is governed by their own privacy policies, not this one.
  • Your details may be provided to more than one lender or broker at a time so that multiple parties can offer you finance options.
  • We may also disclose your information to credit reporting bodies, our service providers (e.g. website hosting, CRM, analytics, customer support platforms), and as required by law, regulation or a court/tribunal order.

If you do not want your details sold or disclosed to third-party lenders and financial services providers on these terms, do not submit an enquiry through this website — you should instead approach lenders or brokers directly.

5. Marketing communications

We and the third parties described in Section 4 may send you marketing communications about finance and related products. You can opt out of marketing communications from us at any time by contacting us using the details below; to opt out of marketing from a specific lender or broker, you will need to contact that party directly, as we do not control their marketing systems once your details have been shared.

6. Overseas disclosure

Some of our service providers (for example, cloud hosting or analytics providers) may store or process information outside Australia. Where this occurs, we take reasonable steps to ensure appropriate safeguards are in place, to the extent required by the Privacy Act.

7. Data security

We take reasonable technical and organisational steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. No method of transmission or storage is completely secure, and we cannot guarantee absolute security, including once information has been disclosed to a third-party lender or broker.

8. Data retention

We retain personal information for as long as reasonably necessary to fulfil the purposes described in this policy, meet our legal and regulatory obligations, and resolve disputes, after which it is securely deleted or de-identified.

9. Access and correction

You may request access to, or correction of, the personal information we hold about you by contacting us using the details below. We will respond within a reasonable time. Note that we cannot access, correct or delete information already provided to a third-party lender or broker — you will need to contact them directly.

10. Cookies and analytics

Our website uses cookies and similar technologies to operate correctly and to understand how visitors use our site. You can control or disable cookies through your browser settings, though some site functionality may not work as intended if you do.

11. Complaints

If you have a concern about how we've handled your personal information, please contact us first using the details below. If you're not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.

We may update this policy from time to time. The "last updated" date at the top of this page reflects the most recent version. Continued use of our website after changes take effect constitutes acceptance of the updated policy.
