These Terms of Use ("Terms") govern your access to and use of the EarthMoving Finance website (the "Site"), operated by EarthMoving Finance, ABN 52 452 030 694 ("EarthMoving Finance", "we", "us", "our"). By accessing or using the Site, including by submitting a quote request, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
EarthMoving Finance operates a finance comparison and referral service for equipment and machinery finance. We are not a lender and do not provide credit. We help connect visitors with lenders, brokers and other financial services providers on our panel. Any finance product is provided by the relevant third party, on its own terms and subject to its own assessment and approval criteria.
Information on this Site is general in nature and does not constitute financial, credit or legal advice. It does not take into account your objectives, financial situation or needs. You should consider whether any product or information is appropriate for your circumstances and seek independent advice before making a decision.
Submitting an enquiry through the Site does not guarantee that finance will be offered or approved. Approval, rates, fees, terms and conditions are determined solely by the lender or broker assessing your application and may vary based on your individual circumstances, the equipment being financed, and the lender's own criteria.
By submitting an enquiry or quote request, you confirm that the information you provide is true, current and complete. Our collection, use and disclosure of your personal information — including to third-party lenders and finance providers on our panel — is described in our Privacy Policy, which forms part of these Terms.
You must not use the Site to submit false, misleading or fraudulent information, attempt to gain unauthorised access to the Site or its systems, interfere with the proper operation of the Site, or use the Site for any unlawful purpose.
All content on the Site, including text, graphics, logos and design, is owned by or licensed to EarthMoving Finance and is protected by copyright and other intellectual property laws. You may not reproduce, distribute or create derivative works from any part of the Site without our prior written consent.
The Site may refer you to, or link with, third-party lenders, brokers and other providers. We do not control and are not responsible for the content, conduct, products or services of any third party. Any dealings you have with a third party after a referral are solely between you and that third party.
To the maximum extent permitted by law, EarthMoving Finance excludes all liability for any loss or damage arising from your use of the Site, reliance on information provided on the Site, or any product or service provided by a third-party lender or broker. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or the Privacy Act 1988 (Cth).
We do not guarantee that the Site will be available at all times or free from errors or interruptions. We may modify, suspend or discontinue any part of the Site at any time without notice.
We may update these Terms from time to time. The "last updated" date at the top of this page reflects the most recent version. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Australia. You submit to the non-exclusive jurisdiction of the courts of Australia in connection with any dispute arising from these Terms or your use of the Site.
